1. Agreement to Terms

By accessing and using the Nakitak Construction website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

Nakitak Construction provides construction, renovation, interior design, and project management services. All services are subject to availability and may be modified or discontinued at any time without notice.

3. Quotes and Estimates

All quotes and estimates provided are valid for 30 days from the date of issue unless otherwise stated. Quotes are based on the information provided at the time and may be subject to change if project scope or requirements change.

4. Payment Terms

  • A deposit may be required before work commences
  • Payment schedules will be outlined in individual project contracts
  • Final payment is due upon project completion and client approval
  • Late payments may incur additional charges

5. Project Timeline

We strive to complete all projects within the agreed timeline. However, delays may occur due to factors beyond our control, including weather conditions, material availability, or unforeseen site conditions. We will communicate any delays promptly.

6. Changes to Project Scope

Any changes to the agreed project scope must be documented in writing and may result in additional costs and timeline adjustments. Change orders must be approved by both parties before implementation.

7. Warranties and Guarantees

We stand behind the quality of our work and offer warranties on our services as outlined in individual project contracts. Warranties typically cover:

  • Workmanship defects
  • Structural integrity (where applicable)
  • Material defects (subject to manufacturer warranties)

8. Client Responsibilities

Clients are responsible for:

  • Providing accurate project information and requirements
  • Ensuring site access for our team and contractors
  • Obtaining necessary permits and approvals (unless otherwise agreed)
  • Making timely decisions on design and material selections
  • Timely payment according to agreed terms

9. Liability and Insurance

Nakitak Construction maintains appropriate insurance coverage for our operations. Our liability is limited to the value of the services provided. We are not liable for:

  • Delays caused by factors beyond our control
  • Damage to existing structures not part of the project scope
  • Issues arising from client-supplied materials or specifications
  • Consequential or indirect damages

10. Intellectual Property

All designs, plans, and creative work produced by Nakitak Construction remain our intellectual property unless otherwise agreed in writing. Clients receive a license to use these materials for the specific project only.

11. Termination

Either party may terminate a project agreement with written notice. In the event of termination:

  • Client is responsible for payment for work completed to date
  • Materials ordered specifically for the project must be paid for
  • Any deposits paid are non-refundable

12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through mediation or arbitration in accordance with Botswana law.

13. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond their reasonable control, including natural disasters, government actions, strikes, or other force majeure events.

14. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and applicable data protection laws. Client information is kept confidential and used only for project-related purposes.

15. Website Use

When using our website, you agree to:

  • Provide accurate information in all forms and communications
  • Not use the website for any unlawful purpose
  • Not attempt to gain unauthorized access to our systems
  • Not transmit any harmful code or malware

16. Modifications to Terms

17. Governing Law

These Terms and Conditions are governed by the laws of Botswana. Any legal proceedings shall be conducted in the courts of Botswana.
